Virtually, every estate plan prepared by SW includes a revocable living trust designed to avoid probate and transfer assets in accordance with your wishes, a financial durable power of attorney to allow a loved one to carry on your financial affairs if you are incapacitated, healthcare documents with an advanced healthcare directive and medical power of attorney, and a pour over will to catch any asset that happens to be outside the trust. We believe, however, that your financial achievements are only a part of your overall “family wealth”. Family wealth includes your intellectual, spiritual and human assets too. Asset Protection

A common misconception about a living trust is that it provides protection from creditors. It does not. Upon the death of one or both of the creators of the trust, however, one can put in place new trusts that do provide this desired asset protection. These asset protection trusts can protect property from creditors and divorced spouses, and ensure that the legacy you worked so hard to build does not evaporate or end up benefiting with someone you did not choose.
