Sean A. Topp specializes in all aspects of business, real estate and commercial litigation representing a variety of companies and individuals, in both state and federal courts, including cases involving breach of contract claims, business tort issues, partnership disputes, commercial landlord/tenant disputes and claims for misappropriation of trade secrets. He is experienced in all aspects of litigation ranging from the initial pleading stage through trial and appeal.
Mr. Topp has extensive courtroom experience, serving as counsel in numerous trials and arbitrations that have returned favorable verdicts and awards for the firm’s clients. Sean is also well versed in all forms of brief writing, including demurrers, Rule 12 motions to dismiss, motions for summary judgment, motions in limine, post-trial motions and state and federal court appeals, as well as being involved in all phases of discovery.
Since joining Steckbauer Weinhart, LLP, Mr. Topp has participated in numerous jury trials, arbitrations and court trials, including conducting both direct and cross examinations of lay and expert witnesses at trial. He has also experienced much success in the appellate courts by drafting multiple appellate briefs that have resulted in holdings affirming the firm’s trial verdicts. In regards to his pre-trial practice, Mr. Topp has successfully briefed and argued motions for summary judgment and demurrers that have resulted in favorable results to the firm’s clients.
Prior to joining Steckbauer Weinhart, LLP, Mr. Topp represented various Fortune 500 companies in cases involving claims of breach of contract, fraud, negligence, and strict products liability in jurisdictions throughout the country. In this capacity, he was part of multiple trial teams that took numerous cases to verdict in both state and federal court. Early in his career, he was involved in the litigation of multiple class actions involving allegations of unfair business practices, securities fraud and antitrust violations.
While in law school, Mr. Topp served as a law clerk for the United States Securities and Exchange Commission’s Enforcement Division and was a member of the University of San Diego’s International Law Review. Concurrently, Mr. Topp earned his Masters of Business Administration at the University of San Diego’s School of Business at which time he was awarded a graduate school fellowship.
Harbor Marina, LLC v. Golden Hills Properties, LLC, Orange County Superior Court Case No. 30-2014-00706930-CU. Second chaired a bench trial regarding claims for declaratory relief and breach of commercial lease, resulting in a verdict in favor of SW’s client in excess of $2.7 million.
Golden Tower Properties, LLC v. Cathedral of Praise, San Bernardino Superior Court Case No. CIVDS1314668. Successfully brought a motion for summary judgment in client’s favor on complaint for breach of commercial lease resulting in SW’s client being awarded hundreds of thousands of dollars in damages and attorney’s fees.
Glencairn Limited v. Lake Forest Alabama, LLC, Los Angeles County Superior Court. Case No. BC480066. Successfully brought a motion for summary judgment in an interpleader action in which the trial court determined that SW’s client was the only party entitled to the proceeds from an insurance policy. The trial court’s ruling on summary judgment was affirmed on appeal.

Lee v. Oh, ADR Services, Inc.; Participated in arbitration involving claims of breach of contract obtaining a Judgment in favor of the Landlord, 2010
Crafty Kids dba Planet Video v. Secret Handshake Entertainment, et al., Los Angeles Superior Court Case No. BC408233; Participated in a three week jury trial wherein a Judgment was obtained in favor of the firms client in a misappropriation of trade secrets case against former employees who misappropriated trade secrets to start a competing company, 2009
National R.V. v. Crane Co., Inc., U.S.D.C. for the Central District of California, Case No. CV06-00803, Participated in a seven week jury trial involving claims of fraud, breach of contract and breach of warranty, 2008.
